Mrudgandh Associate Farmer - T&C

1. You agree to the terms and conditions outlined in this Terms of Use Agreement (“Agreement”) with respect to be an Associate Farmer at Mrudgandh@Kodre Farms.. This Agreement constitutes the entire and only service agreement between us and you with respect to “Mrudgandh” and supersedes all prior or contemporaneous agreement, representations, warranties and understandings.
2. The agreement is for limited use of the land during and in no way the ownership rights are with the Owners. there will be no upon the land
3. Associate Farmer Fee is not refundable under any circumstances.
4. Associate Farmer membership is not transferable and is only valid up to its date of expiry. 
5. Admittance to the Mrudgandh is conditional upon presentation of valid documents and you are required to inform in advance about the no. of guests.  “Mrudgandh” reserves the right to entry to visitors in order to maintain discipline, avoid overcrowding etc..
6. When entering “Mrudgandh” premises, Associate Farmers will have to make entry in the ‘Record of Visit’ log sheets. Wherever applicable, the Associate Farmers must sign the ‘Record of Visit Log, which will also reflect the exact number of accompanying guests. 
7. The Associate Farmers and accompanying guests must abide by the rules and policies of Mrudgandh. Access may be restricted due to space constraints but this will be wholly at the discretion of Mrudgandh. 
8. The administrators of “Mrudgandh” will use every endeavor to ensure the benefits and facilities are available as promised, but “Mrudgandh” or any entity associated with it, does not warrant nor guarantee in any way that said benefits and facilities will be available at the time of the Mrudgandh Associate Farmer’s visit. “Mrudgandh” or any entity associated with “Mrudgandh”, will not be liable for any loss to Mrudgandh Associate Farmer, or any accompanying guests, arising from the provision or non -provision (whether in whole or in part) of any of the advertised benefits and facilities. All accompanying children (where permitted) will have to be supervised and should be taken care of .
9. “Mrudgandh” or any entity associated with “Mrudgandh” shall not be liable for any loss, physical  or mental injury by the Mrudgandh Associate Farmer and/ or any guests while present at Mrudgandh Site.
10. Consumption of alcoholic drinks / tobacco or related products is strictly prohibited at Mrudgandh site.
11.  The responsibility of Goods, materials of the Mrudgandh Associate Farmer and guests will be of the individuals. “Mrudgandh” will not be liable for any unfortunate incident. “Mrudgandh” aggregate liability for damages claimed under this agreement and arising out of “Mrudgandh” performance of services hereunder shall be limited to the total purchase price you pay for any goods, services or information.
12.  The Organic practises adopted for farming is to be strictly followed and in no way Associate Farmers can use chemical fertilizers, pesticides.
13.  The seeds, Saplings, fertilisers, pest controls or any other material required at the farm is to be paid directly by the Associate Farmers. While Mrudgandh will try to make this available at the site, it is no way responsible for the timely availability of the same.
14.  Renewal terms and conditions are at the discretion of “Mrudgandh”.
15. “Mrudgandh” or any entity associated with “Mrudgandh” shall not be held responsible for any disputes that may occur between Mrudgandh Associate Farmers.
16.  The Membership term (validity period) shall be for a period of either 6 months or for 1 year starting from the start of the activity on the farmland, depending upon the selection for the membership period.
17.  All food and beverage certificates to be used at Mrudgandh are chargeable and will have to be paid at actuals.
18.  “Mrudgandh” reserves the right at any time at its absolute discretion and without notice to revoke membership of Mrudgandh Associate Farmer. Where applicable a proportional refund of the annual fee/enrollment fee (whichever is applicable) will be made provided revocation has not been made because of fraud by the in “Mrudgandh”. 
19.  Mrudgandh does not guarantee the quantity & quality of the produce as it depends on various factors like climatic conditions, etc.
20.  As a Mrudgandh Associate Farmer, You agree that you will defend and indemnify “Mrudgandh” or any entity associated with “Mrudgandh”, its partners, officers, employees and agents  (collectively ‘the indemnified parties’) against and hold each indemnified party harmless from all liabilities, damages, losses, claims, suits, judgments, costs and expenses (including reasonable attorney’s fees) for injury to or death of any person or damage to or destruction of any property arising out while at Mrudgandh Property. 

Under No Circumstances Shall Mrudgandh  its partners, officers, employees and agents  (collectively ‘the indemnified parties’)  Be Liable For Any Direct, Indirect, Punitive, Incidental, Special, Or Consequential Damages to Mrudgandh Associate Partner and the guests/ kids that Result while at Mrudgandh.
